Terms and Conditions (T&C) for EAGLWEAR
1. Scope of Application
These Terms and Conditions (T&C) apply to all orders placed through our online shop, regardless of whether the customer resides in Switzerland, an EU member state, worldwide. By submitting an order, you agree to these Terms and Conditions.
2. Contracting Party
The purchase agreement is concluded with Eaglewear.ch. Detailed contact information and further company details can be found in the Legal Notice (Imprint) on our website.
3. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer. By submitting an order, you make a binding offer to purchase the selected products. The contract is concluded once we confirm your order by email or dispatch the goods to you.
4. Prices and Shipping Costs
All prices are stated in Swiss Francs (CHF).
Free Shipping
We offer free shipping on all orders.
Value Added Tax (VAT)
Customers in Switzerland
Currently, no VAT is charged, as Swiss VAT registration becomes mandatory only once annual revenue exceeds CHF 100,000. Should this threshold be exceeded in the future, VAT will be displayed accordingly.
Customers worldwide
Prices shown in the shop exclude any customs duties, import taxes, or additional fees, which must be paid by the customer upon delivery.
5. Payment Terms
Payment must be made using the payment methods provided during the checkout process. The invoice amount is due immediately and must be paid in full before the goods are shipped.
For customers outside Switzerland, currency conversion fees may apply depending on the respective payment provider.
6. Delivery
Delivery is made to the address specified by the customer.
Delivery Times
Estimated delivery times are stated in the respective product descriptions and during the ordering process. While we strive to comply with the stated delivery times, we cannot be held liable for delays beyond our control, including but not limited to customs clearance procedures or unforeseen shipping issues.
Customs and Import Charges
Deliveries to the EU and worldwide may be subject to additional customs duties and import charges, which are the responsibility of the buyer. Please contact your local customs authorities for further information regarding possible charges.
7. Right of Withdrawal and Returns
Customers in Switzerland
Swiss law does not provide a mandatory right of withdrawal for online purchases.
Customers in the European Union
In accordance with the EU Consumer Rights Directive, you have the right to withdraw from the contract within 14 days without providing any reason.
Exceptions
The right of withdrawal does not apply to personalized or custom-made products.

Customers worldwide
The locally applicable return and withdrawal regulations apply. We strive to provide fair and reasonable solutions for return requests.
8. Retention of Title
The goods remain our property until full payment has been received.
9. Warranty and Liability
Customers in Switzerland
Under the Swiss Code of Obligations, customers are entitled to warranty rights in the event of defective goods. In the case of faulty or defective products, customers are entitled to repair, replacement, or refund of the purchase price.
Liability for slight negligence is excluded to the extent permitted by law.
Customers in the European Union
Warranty rights are governed by the statutory provisions of the respective EU member state. In the event of defects, customers are entitled to repair, replacement, or refund.
Customers worldwide
The applicable statutory warranty regulations of the respective country apply. We strive to provide satisfactory solutions for justified warranty claims.

11. Applicable Law and Jurisdiction
Customers in Switzerland
Swiss law shall apply exclusively, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the registered office of Shipi-Shop.ch.
Customers in the European Union
The law of the country in which the consumer has their habitual residence shall apply where mandatory legal provisions require it. Otherwise, Swiss law shall apply.
Customers worldwide
Local law shall apply. Where applicable, Swiss law shall additionally apply.
